The following Digital Millennium Copyright Act (DMCA) Policy explains how CodesenSys handles claims of copyright infringement and the steps both copyright holders and accused infringers should take.

1 Designated Agent

2 Filing a Takedown Notice

  • Must include all elements of 17 U.S.C. § 512(c)(3):
  • 1. Signature : Physical or electronic signature of the copyright owner (or authorized agent).
  • 2. Identification of Work : Identification of the copyrighted work being infringed.
  • 3. URL or Location : Precise URL or other location of the allegedly infringing material.
  • 4. Contact Information : Contact information of the complaining party.
  • 5. Good-Faith Statement : A good-faith statement that use is unauthorized.
  • 6. Perjury Statement : A statement, under penalty of perjury, that the notice is accurate.
  • Send the complete notice to the Designated Agent by email or certified mail.

3 CodesenSys Response

  • We acknowledge receipt within 48 hours.
  • If the notice is facially valid, the content is removed or disabled within 72 hours.
  • The uploader (or repository maintainer) is notified and given a copy of the claim.

4 Counter-Notice Procedure

  • Alleged infringer may submit a counter-notice per 17 U.S.C. § 512(g)(3), containing:
  • 1. Signature : Their physical or electronic signature.
  • 2. Removed Material : Identification of removed material and its prior location.
  • 3. Good-Faith Statement : A good-faith statement that removal was a mistake or misidentification.
  • 4. Jurisdiction & Process : Consent to jurisdiction of a U.S. federal court (or local equivalent for non-U.S. users) and agreement to accept service of process.
  • Upon receipt of a valid counter-notice, CodesenSys forwards it to the original complainant.
  • Content may be restored 10–14 business days after forwarding, unless the complainant files a court action.

5 Repeat-Infringer Policy

  • Accounts or vendor relationships linked to three substantiated infringements within any 12-month period will be suspended or terminated.

6 Good-Faith Requirement & Misrepresentation

  • Submitting false claims or counter-claims can lead to legal liability for damages (17 U.S.C. § 512(f)).
  • Both parties should thoroughly verify ownership or fair-use defenses before filing.

7 Record-Keeping & Transparency

  • All notices and counter-notices are logged for five years.
  • An anonymized summary of takedown statistics is published annually in our Transparency Report.

8 Policy Updates

  • Reviewed yearly; the revision date appears at the top of the online policy.
  • Continued use of our services after updates signifies acceptance of the revised DMCA Policy.
